Better monetary situation will not be a foundation for baby custody- High Court

Jaipur. The Rajasthan High Court has refused to provide custody of a seven-year-old baby to a Dubai-based father by taking him away from his mom. The court docket mentioned that doing so wouldn’t be in the most effective curiosity of the kid. The court docket mentioned that the monetary situation of the daddy can’t be decisive in deciding whether or not the custody of the kid needs to be handed over to him. The division bench of CJ MM Shrivastava and Justice Shubha Mehta gave this order whereas disposing of the daddy’s habeas corpus petition.

The father had filed a habeas corpus petition within the High Court saying that his spouse has illegally stored his minor baby in her custody. His son was born in Dubai and was residing there usually, however she introduced him to India illegally with out his data. Her conduct in direction of the kid can also be not proper, so she needs to be given custody of her baby.

The division bench gave the choice in favor of the mom and allowed the kid to stick with the mom and disposed of the petition by giving the daddy the liberty to satisfy him.
